FBI Director James Comey recently revealed that he will not be recommending criminal charges against Hillary Clinton for her use of a private server to house and process her emails while Secretary of State. Only days after meeting with Bill Clinton, United States Attorney General Loretta Lynch also announced that no charges will be pursued against the presumptive Democratic Presidential nominee.

I really go back and forth on indicting Hillary after the election. It’s not a legal argument — there’s no doubt that she can legally be indicted. Jeopardy hasn’t attached, the statute of limitations hasn’t tolled, etc etc.

On the other hand, there’s a Rubicon there that I think would be bad for the Republic to pass. Right now, one of the elements of peaceful transfers of power is that the loser gets to just walk away. (Obama has himself, in fact, eroded some of this with the IRS bullshit.) That means that you can have an honest fight, and you can afford to lose the fight.

Once we get to the point that the candidate herself gets prosecuted as a result of losing the election, even if she deserves it, the stakes suddenly get much much higher for the election. Now, it is win or go to jail, and there is an incentive to commit even more fraud and shenanigans and crimes — because instead of being able to walk away, it is win or go to jail.

Hillary put us in this situation. I don’t want to even possibly insinuate that she’s some sort of victim in this. She has, however, put us in a Xanatos Gambit that benefits her — if we don’t prosecute her, we weaken the nation by damaging the rule of law, possibly mortally. If we do prosecute her, we instead certainly kill the republic, because now the presidential election is a bloodsport, and the loser goes to jail.

So, it’s apocalypse either way.
