I finally read her lawsuit against Trump from yesterday. It’s complete and total crazypants. It reads like it was written by a jailhouse lawyer.
First, she’s suing on behalf of the NY people. I frankly don’t think they have standing. The cases where “The People” have standing are things like credit card companies defrauding thousands of citizens, class action style stuff. Allegedly, the people defrauded here are Wall Street banks, who are more than capable of pursuing their own fraud claims. So I honestly expect it to be bounced on standing pretty quickly (meaning a couple of months.)
If she does have standing, she doesn’t have a claim. All of the claims are based on the NY penal code. The DA has already passed on this. A private victim could successfully sue based on the penal code, but not the AG. The DA gets the call on that one. Then she’s asking for crazypants death penalty injunctions for things that all have potential damages associated. Before you get there, you have to go through damages and show that a financial penalty doesn’t get the (unidentified, powerful banker) victims whole.
It’s just wacky. It’s not worth going into detail on it because it’s ridiculous.
